Terms and Conditions

Terms and Conditions

The purchaser hereby acknowledges reading and hereby accepts the following terms and conditions relating to a purchase from Tealman’s Terracotta Warriors, LLC (the “Company”)

Currently the Company only sells in the lower 48 United States.

Shipping Agreement

All products will be shipped from China via ocean container.  Normal shipping time will range between six to eight weeks. The Company is a licensed import broker and will secure the product from China to the US and clear all customs. Any tariffs and duty costs in either country will be paid by the Company.  The product will be received in Indiana with final shipment to the customer’s location by a shipping company selected by the Company.  If the customer desires to pickup the product in Indiana, please contact the Company for arrangements.  The customer will be contacted by the carrier to establish a delivery date and time that is convenient.  The Company shall pay all costs to deliver the product to the customer’s location.

Payment Method

Full payment is required in US currency using a debit or credit card by using the shopping cart that is provided on this web site utilizing E-Processing.  Master card, Visa, American Express and Discover Cards are all accepted.

Pricing

The pricing for a product is all inclusive in that it includes all costs to secure the product, packaging of the product, China custom duties, fees and tariffs, shipping by ocean vessel, US customs duties, fees and tariffs and delivery of the product directly to the customer’s location.

Customers Responsibility

Upon delivery to the customer’s location, the carrier shall unload the product from the truck and with help from the customer move it to a secure location (such as a garage). All care should be taken to not drop or bump the crate into any objects while moving. While the carrier is present, the customer shall remove the top wood cover and the side wood panel with the word “FACE” marked on it. If the removal of additional panels is necessary to assure that no damage has occurred, the customer shall remove any necessary panels. While the carrier driver is present, the customer shall verify the product is not damaged. Once the customer has been assured that the product has been delivered undamaged, the customer shall sign accepting delivery which shall transfer any risk of loss to the customer. If the customer decides to not open the crate while the driver is present all liability is the customers. The carrier will not move the product up or down any stairs place it in a house or final resting place, that is the customer’s responsibility.

Damaged/Cancellation/Refunds

Damaged

If a product is discovered to have damage or breakage, it will need to be crated back up and the carrier will return the product to the Company.  The customer shall take a date stamped photo while the driver is present and can witness the damage and shall contact the Company.  The Company will arrange for the Customer to receive a replacement product at no additional cost with delivery as soon as possible. The customer will alternatively have the option to receive a full refund.

Cancellation/Refunds

If an order is canceled within 72 hours after the order is placed, the customer will receive a full refund.

Order cancellation requests placed after 72 hours but before 168 hours (1 week) will result in a $300 cancellation fee and the balance of your order will be refunded.

No cancellation shall be allowed after 168 hours (1 week).

All cancellations shall be processed by contacting us by phone or email within the time limits specified.

Taxes

The Company will pay any tariffs, duties of other fees incurred in importing the product. The Company may or may not be required to charge sales tax on the purchase. If the Company does not charge sales tax for any purchase, it is the customer’s responsibility to pay any taxes, including but not limited to use tax that may be due as a result of the purchase.
